OLYMPIC COMMITTEE OF SERBIA
S T A T U T E S
OF THE OLYMPIC COMMITTEE OF SERBIA
- Belgrade, February 2007 -
Pursuant to the Article 15 of the Statutes of the Olympic Committee of
Serbia, the Assembly of the Olympic Committee of Serbia, at its sessions
held on March 25, 1995, April 9, 1996, December 6, 1996, September 17,
1999, March 28, 2002, April, 3rd 2003, March 27, 2004, February 22,
2005, July 11, 2005, March 7, 2006, June 8, 2006, and February 27, 2007,
enacted
S T A T U T E S
OF THE OLYMPIC COMMITTEE OF SERBIA
WHEREAS
We, the Olympic Committee of Serbia (hereinafter: OCS), an organization
belonging to the Olympic Movement, duly represented by the undersigned,
hereby undertake to respect the provisions of the Olympic Charter and
the World Anti-Doping Code and to abide by the decisions of the IOC.
We undertake, in accordance with our mission and role at national level,
to participate in actions to promote peace and to promote women in
sport. OCS also undertake to support and encourage the promotion of
sports ethics, to fight against doping and to demonstrate a responsible
concern for environmental issues.
We undertake to comply with Rules 28 to 32, including Bye-law to Rules
28 and 29 of the Olympic Charter, specifying the issues related to the
National Olympic Committees.
IT IS HEREBY ENACTED AS FOLLOWS:
I GENERAL PROVISIONS
Article 1
Olympic Committee of Serbia is a sports organization with which are
associated all National Olympic Sports Federations of Republic of Serbia
affiliated in the International Sports Federations, for the purpose of
accomplishing common aims and interests, defined by these Statutes.
The OCS shall not recognize more than one national federation for each
sport governed by IF governing sports included in the programme of the
Olympic Games.
The OCS Members are also members of the International Olympic Committee
(hereinafter: IOC), in Serbia.
The OCS Member is also the Sports Association of Serbia.
Other Sports Federations of Republic of Serbia, affiliated with their
respective International Sports Federations recognised by the IOC, can
also become members of the OCS.
Article 2
The OCS is a non-governmental, non-political and non-profitable sports
organization and National Olympic Committee of the Republic of Serbia.
The OCS has the status of a legal entity.
Article 3.
Members of the OCS members are National Sports Federations of the
Republic of Serbia (Serbian Sports Federations), registered in
accordance with the Sports Law of the Republic of Serbia and affiliated
with their respective International Sports Federations included by the
programme of the Olympic Games, or the Sports Federations of the
Republic that have assumed rights and obligations from the respective
sports federations of Serbia and Montenegro.
The affiliated members, recognized by the OCS are sports associations
and federations of the Republic of Serbia, registered in accordance with
the Sports Law of the Republic of Serbia, that have assumed rights and
obligations of the associations and federations of SCG NOC affiliated
members.
A certain number of active and former athletes who have participated in
the Olympic Games also make part of the OCS, provided that the latter
have to withdraw from that position the latest after the third Olympic
cycle following the last Olympic Games they participated in.
The OCS members are also the IOC members in Serbia and the IOC Athletes'
Commission members in Serbia.
Admission of affiliated OCS members is the exclusive right of the OCS
Assembly. A special decision of the Assembly regulates in detail their
rights and duties.
An IOC member, IOC honorary member or IOC honour member expelled from
the IOC may not be a member of the OCS.
Article 4
The OCS is recognized by the IOC and its role is to develop and spread
the ideals of the Olympic Movement in Serbia, in accordance with the
Olympic Charter.
The OCS is a member of the Association of National Olympic Committees (ANOC),
European Olympic Committees (EOC), International Committee of
Mediterranean Games (ICMG), Association of Balkan National Olympic
Committees (ABNOC), European Non-Governmental Sports Organization (ENGSO),
and European Fair-Play Movement (EFPM).
The OCS abides by and applies the IOC Rules. It must preserve its
autonomy and resist all pressures of political, religious or economic
character that can prevent its activities to be in accordance with the
IOC Rules.
In case of any doubt that may occur related to the meaning or
interpretation of the Statutes provisions, or if any contradictions
occur between the Statutes and the IOC Rules, the IOC Rules shall apply
(Olympic Charter).
Article 5
The work of the OCS Institutions is public.
The name of the Olympic Committee of Serbia shall be “Olympic Committee
of Serbia”.
The area of activity of the Olympic Committee of Serbia shall be the
territory of the Republic of Serbia.
Article 6.
The OCS has its flag, its emblem and its anthem.
Basis of the flag is the national flag of the country, with five
intertwined circles placed on the blue area (the circles are coloured in
blue, yellow, black, green and red).
Dimension of the OCS flag is determined by the Presidential Board of the
OCS Assembly.
The OCS emblem is the national flag with five Olympic circles
intertwined above and inscription SERBIA underneath.
The symbols of the OCS mentioned in paragraphs 2 and 4 above are the
exclusive property of the OCS and shall be used in full compliance with
the IOC Rules.
The flag, the emblem and the anthem adopted by the OCS for use in
relation to its activities, including the Olympic Games, must be
approved by the IOC Executive Board.
The OCS symbols are protected according to the respective law.
Article 7
The OCS seal is circular in form, 3 cm in diameter. In its centre is the
emblem of the OCS, surrounded by the inscription in Serbian on the
border of the seal: "Olimpijski komitet Srbije - Beograd".
Article 8
The seat of the OCS is in Belgrade, Generala Vasica Street No. 5.
II MAIN AIMS OF OCS
Article 9
Main aims of the OCS are:
• to encourage and contribute to the promotion of the ideas of Olympic
Ideals and the development of sport in general;
• to respect fundamental principles of the Olympic Movement;
• to develop and protect the Olympic Movement in Serbia, in accordance
with the Olympic Charter;
• to represent Serbia at the Olympic Games and other regional,
continental or international competitions and sports events under the
auspices of the IOC;
• to ensure adherence to the Olympic Charter in Serbia and to fight
against all forms of discrimination and violence in sports;
• to adopt and implement the World Anti-Doping Code, thereby ensuring
that the NOC Serbia’s anti-doping policies and rules, membership and/or
funding requirements and results management procedures conform with the
World Anti-Doping Code and respect all the roles and responsibilities
for NOCs that are listed within the World Anti-Doping Code;
• to ensure co-operation with NOCs and respective International
Organizations;
• to organize the Olympic Games if entrusted to the OCS by the IOC, as
well as other international meetings and competitions patronized by the
IOC;
• to encourage education and advance training of sports experts;
• to foster activities to provide the material conditions necessary for
the preparation and participation athletes of Serbia in the Olympic
Games and other corresponding events (Mediterranean Games, etc).
The OCS is obliged to participate in the Olympic Games by sending
athletes.
The OCS is obliged to constitute, organize and lead its respective
delegations at the Olympic Games and at the regional, continental and
word multi-sports competitions patronized by the IOC. The OCS is
responsible for the behaviour of the members of its delegations.
Article 10
For the purpose of accomplishing its fundamental goals, the OCS
co-operates with the Federations of Olympic Sports of Serbia, with the
Ministry in charge of sports and other State bodies, Anti-doping Agency
of the Republic of Serbia, Institute for Sports of the Republic and
associations in the domain of sports in the Republic of Serbia, in order
to effectuate programs for preparation and participation of athletes and
teams in the Olympic Games and other corresponding sports events, and
organizes commercial activities, engaging sponsors to participate in
their financing; establishes and realises education and training
programs for sports experts; implements respective provisions of IOC
Rules and decisions; represents sports interests of Serbia in the
International Sports Movement, and engages in other activities and
endeavours in accordance with the Statutes.
In order to fulfill its mission, OCS may cooperate with governmental or
non-governmental bodies. However, OCS must never associate itself with
any activity which would be in contradiction with the Olympic Charter.
Governments or other public authorities shall not designate any members
of the OCS. However, the OCS may decide, at its discretion, to elect as
a members representatives of such authorities.
As a special form of activity within the OCS, there act National Olympic
Academy of Serbia and Committee Pierre de Coubertin of Serbia.
III RIGHTS AND OBLIGATIONS OF THE OCS MEMBERS
AND THEIR REPRESENTATIVES
Article 11
The OCS members give propositions and participate in taking measures for
accomplishing the OCS goals; they propose athletes and teams which are
to participate in the Olympic Games and other corresponding sports
events, based on criteria determined by the respective OCS Organs; elect
and revoke their representatives into the OCS Organs; implement
decisions and conclusions of the OCS Organs, made in accordance with the
Statutes; perform other statutory rights and obligations.
The OCS member has the right to leave the membership of the OCS if
requested by the respective statutory institution of the Federation or
Organization, and provided it has met all its financial and other
obligations towards the OCS and/or other OCS member.
Article 12
The OCS member shall inform the OCS President in due time of all events
that may endanger implementation of the Olympic Charter in Serbia or the
OCS Statutes, whether they occur within the affiliated sports federation
or without it.
Representatives of the OCS members have the right and the obligation
• to participate in the work and decision-making in the OCS Organs and
to be informed about their work;
• to participate as the OCS representatives in the work of other
organizations and bodies;
• to solicit implementation of adopted decisions of the OCS Organs in
Federations from which they were elected in these organs and
• to perform other activities in accordance with the Statutes and the
Regulations of the OCS Assembly.
Representatives of the OCS members, with the exception of those who
devote themselves to the administration of sport, shall accept no salary
or bonus of any kind in consideration for the performance of their
functions.
Article 13
The OCS members shall settle disputes between each other and disputes
with the OCS Organs by the means of Internal Arbitration.
Establishment, composition and procedure of the Arbitration Council is
defined by the the Regulations of the OCS Assembly.
Subject to Article 14 below the decision of the Arbitration Council is
final.
Article 14
Any decision made by the Arbitration Council may be submitted
exclusively by way of appeal to the Court of Arbitration for Sport in
Lausanne, Switzerland, which will resolve the dispute definitively in
accordance with the Code of Sports-Related Arbitration. The time-limit
for appeal is twenty-one days after the reception of the decision
concerning the appeal.

Article 15
The Assembly being the supreme authority of the OCS:
• creates OCS activity plans and programs;
• enacts Statutes and other acts and documents of the OCS, and
interprets their provisions;
• decides about the admission of members into the OCS and affiliation of
the OCS into other Federations or organizations, of which may decide the
Presidential Board of the Assembly, with consequent consent of the
Assembly;
• makes financial plan;
• elects and revokes the OCS President, members of the Presidential
Board of the Assembly and members of the OCS Auditing Committee from the
athletes and people engaged in sports;
• suggests persons candidates for IOC for the election of IOC member in
Serbia;
• suggests the city in Serbia as a candidate for organization of the
Olympic Games or other corresponding sports events (Mediterranean Games,
etc.);
• verifies withdrawal of a federation or an organization from the OCS
membership;
• nominates and revokes honorary members of the OCS, under the
conditions and in procedure defines by special and general acts of the
Assembly;
• may trasfer certain authority to the Presidential Board;
• nominates and revokes members of the working bodies of the OCS
Assembly;
• enacts Regulations of the OCS Assembly;
• performs other activities determined by the Statutes.
Article 16
Assembly is composed of the representatives from each of the Olympic
Sports Federations of Republic of Serbia (majority of votes), and
affiliated members, four representatives of the Sports Federation of
Serbia, and sixteen athletes nominated by the Sports Federations of
Republic of Serbia, who have won medals in the Olympic Games, in
accordance with Article 3 paragraph 3 of the Statutes.
The mandate duration of persons who are the OCS Organs members
(representatives of the Federations and other organizations) is four
years, which can cease before the expiration of the four-year-period, in
case of resignation or revocation of a person.
IOC members in Serbia are legal members of the Assembly and its
executive body with right to vote.
Article 17
As a rule, the Assembly is convened once a year.
The Election Assembly is held within the six months following the
Olympic Games.
The Assembly is summoned by the OCS President at its own decision, at
the request of the Presidential Board of the Assembly (hereinafter:
Presidential Board), or the OCS Auditing Committee, and at the request
of minimum five OCS members.
The Session of the Assembly may start if more than half members of the
Assembly are present.
General documents (decisions, resolutions, conclusions, instructions,
etc.) are adopted by the majority of votes cast by the representatives
present in the Assembly.
In exception, the OCS Statutes is adopted by the Assembly by a majority
of votes from the total membership of Assembly.
The procedure and election of members for the OCS Organs are determined
in the Regulations of the Assembly.
Article 18
In all issues related to the Olympic Games, only the votes of the
members of the Presidential Board and representatives of the Olympic
Sports Federations affiliated of Serbia in the International Sports
Federations shall be taken into account (Olympic Charter, Rule 29,
paragraph 3).
Article 19
All activities of the Assembly between the two sessions are performed by
the Presidential Board, as the executive and managing body of the
Assembly.
Presidential Board is composed of the following: the OCS President, the
IOC Member from Serbia and 16 members elected from the Sports
Federations of Republic of Serbia, out which 12 members are from the
Olympic Sports Federations of Republic of Serbia and 4 from the
affiliated member Federations, nominated by a majority of votes in their
categories, and elected and revoked by the Assembly.
Members of the Presidential Board are also two representatives from the
Sports Association of Serbia, nominated and revoked by the same
Association.
Member of the Presidential Board is also one representative of the
National Olympians Association, nominated and revoked by the same
Association.
Member of the Presidential Board is also one representative of the
Olympic Winter Sports Federations of Republic of Serbia, nominated by
these Federations, if in the process of election no representative of
these Federations is elected.
Members of the Presidential Board take an oath at the session of the OCS
Assembly. Form of the oath is determined by the Presidential Board in a
general act.
The Presidential Board, at the proposition of the OCS President,
nominates and revokes four vice-presidents from the membership of the
Presidential Board.
Also members of the Presidential Board by position and without the right
to vote, may be Presidents of various working bodies (commissions,
boards, councils, etc.), if not elected for members in the election
procedure. They are nominated and revoked by ther Presidential Board.
The mandate duration of the Presidential Board Members, with the
exception of IOC Member from Serbia, is four years, and can cease in
accordance with the Article 16, paragraph 2 above.
The voting majority of the Presidential Board shall always consist of
the votes cast by the Olympic Sports Federations or their
representatives.
Article 20
The OCS President is at the same time President of the Assembly and of
the Presidential Board.
The President convenes all sessions of the Presidential Board at its own
initiative, at the request of the Auditing Committee, or at the
proposition of minimum five OCS members or five members of the
Presidential Board.
The decisions and conclusions made by the Presidential Board will be
valid only if majority of the Presidential Board members are present at
the session.
2. P R E S I D E N T I A L B O A R D
Article 21
The Presidential Board being executive and managing body of the OCS
Assembly:
• executes the decisions and conclusions made by the Assembly and acts
taking all respective measures authorised of the Assembly;
• initiates and exposes all current issues and problems before the
institutions and organizations in charge;
• makes decisions related to the participation of athletes and teams in
the Olympic Games, Mediterranean Games and other corresponding events in
charge of the organization whose member is the OCS, and determines their
composition according to the propositions made by participating votes of
majority of Olympic Sports Federations of REPUBLIC OF SERBIA affiliated
in the International Sports Federations;
• conducts activities to provide material conditions necessary for the
preparation and participation athletes of Serbia in the Olympic Games
and other corresponding events (Mediterranean Games, European Youth
Olympic Festivals - summer and winter editions, etc);
• decides the proposition for the financial plan and program, adopts the
balance sheet and distributes the resources from the financial plan;
• nominates and revokes the Secretary General of the OCS, at the
proposition of the OCS President;
• decides on concluding legal transactions;
• submits to the Assembly reports on its work;
• suggests to the Assembly amendments or revisions of Statutes or other
general documents in charge of the Assembly and enacts general documents
or acts in its charge;
• awards acknowledgements, rewards and commendations;
• provides means for the needs of the OCS and considers purposeful use
of those means;
• enacts Regulations of the Presidential Board;
• nominates and revokes members of the working bodies of the
Presidential Board;
• participates in regulating working and legal relations of employees in
the administrative office;
• performs all other activities defined by the Statute and Regulations.
3. O C S P R E S I D E N T
Article 22
The OCS President shall represent OCS in all occasions.
The OCS President convenes sessions of the Assembly and the Presidential
Board and chairs these meetings.
The OCS President looks into the work of the OCS Organs.
The OCS President determines permanent and temporary commissions, i.e.
working groups whenever he deems it necessary, sets their tasks and
nominates their members, deciding to recall them when he estimates that
their work has been accomplished.
In the event of the OCS President being temporarily unable to perform
his duties, he is replaced by one of the vice-presidents authorised by
him.
In the event such inability being permanent, he shall be replaced by the
vice-president decided by the Assembly, giving him all rights and
obligations of the president.
Article 23
In the event of urgency, the OCS President or the Presidential Board may
decide to have the vote related to the matter in written, through
correspondence with the members of the Presidential Board within the
deadline.
If the number of positive replies in written represents the majority of
total number of Presidential Board members, the decision shall be
adopted. The result must be notified to all members of the Presidential
Board.
If there is any doubt as to formal validity of replies in written (delay
of the mail), as to material validity of one or more replies, the OCS
President shall finally decide on validity of the replies received.
The decisions or actions taken in the event of urgency, cannot be
applied to the amendments of the OCS Statutes.
Article 24
Secretary General performs all tasks related to implementation of
decisions and conclusions of the OCS Organs; he is director for the
execution of the OCS financial plan; he represents all economic and
other activities of the OCS and is responsible for legality of work and
dealings of the OCS.
The Secretary General is responsible for his work to the Presidential
Board.
The Secretary General perform his work professionally.
If a member of the Assembly is nominated for the office of the Secretary
General, his term in the Assembly automatically ends on the day of
nomination for OCS Secretary General.
The Secretary General is nominated for the term of 4 (four) years.
4. A U D I T I N G C O M M I T T E E
Article 25
The Auditing Committee (hereinafter: Committee) is composed of three
members.
Members of the Committee are elected for the term of four years, which
can be terminated before the period expires by the resignation of the
member.
Members of the Committee elect the President of the Committee.
The Committee enacts its Regulations.
Article 26
The Committee supervises the use of the OCS financial means by auditing
the balance sheet and studying the accounting documents. It reports to
the Assembly, the Presidential Board and to the OCS Secretary General,
who must study the report and take the measures accordingly.
The report of the Committee of the annual financial dealing of the OCS
is previously considered by the Presidential Board.
The Committee informs the Assembly of its work at least once a year.
5. O C S A T H L E T E S C O M M I S S I O N
Article 27
OCS Athletes Commission is a consultative body of the OCS, which should
ensure that the athletes points of view are are taken into cosideration
in the process of the OCS making decisions.
OCS Athletes Commission ensures the respect of the rights of the
athletes within the Olympic Movement and it can draw up recommendations
to that effect.
OCS Athletes Commission, in co-operation with the Serbian national
sports federations the OCS members, puts forward nominations for the
Serbian candidates in the IOC and EOC Athletes Commissions, based on the
IOC and EOC criteria.
OCS Athletes Commission enacts its rules and regulations.
Article 28
OCS Athletes Commission is composed of the Serbian athletes who
participated at the Olympic Games in their respective sport.
Members of the OCS Athletes Commission is appointed by the National
sports federations of REPUBLIC OF SERBIA the OCS members representing
the olymcic sports. Each federation can appoint one member of the OCS
Athletes Commission.
For the OCS Athletes Commission member can be appointed an athlete who:
• won a medal at the Olympic Games or took place at the final part of
the competition in his/her respective sport at the Olympic Games;
• is still active in the respective sport or in sports organizations.
An athlete who violated any rule concerning doping, cannot be appointed
for the member of the OCS Athletes Commission.
Members of the OCS Athletes Commission is appointed for a period of 4
years and this mandate is renewable.
The OCS Athletes Commission members are also members of the IOC and EOC
Athletes Commissions, in Serbia.
Article 29
OCS Athletes Commission has a chairperson who is chosen among the
members of the commission, by themselves.
Chairperson is, ex officio, member of the OCS Presidential Board.
V THE OCS RESOURCES
Article 30
The OCS accumulates financial resources from organizing marketing and
other activities, from donators and sponsors, from the budget of funds
and foundations established by the OCS and from selling television
rights.
The OCS effectuates income from companies OCS founded in accordance with
the law.
Article 31
Incomes and expenditures of the OCS are determined by the annual
financial plan of the OCS.
The finances of the OCS are used to finance a part of the final
preparations and participation of the athletes in the Olympic Games and
other corresponding events (Mediterranean Games etc.) and accomplishment
of other program tasks and obligations of the OCS.
The OCS is responsible for the obligations it has with all its means.
VI ADMINISTRATION OFFICE
Article 32
Administration and office work for the need of the OCS is performed by
the employees of the OCS.
The domain of the administration office and number of employees to
accomplish the work and tasks is determined by general documents.
The OCS Secretary General is the manager of the administration office.
The work on specific materials and drawing-up of general documents can
be entrusted to other organizations and experts.
VII DISSOLUTION
Article 33
The OCS may cease to work under the conditions determined by the law or
by the decision of the OCS members. The property of the OCS, in event of
dissolution, shall be transferred to the legal successor of the OCS.
VIII TRANSITIONAL AND CLOSING PROVISIONS
Article 34
General documentes, regulary, shall take effect 8 (eight) days from the
day they are announced in public in the OCS Seat.
The Statutes shall take effect on the 8th day from the day of
announcing.
Article 35
The Statutes of the OCS shall, at all times, be in accordance with the
Olympic Charter and refer expressly to the latter.
Any subsequent change to the Statutes as originally approved by the IOC
shall also be communicated to the latter with a request for approval.
General documents of the OCS must be, at all times, in accordance with
the Statutes.
General documents of the OCS must be in conformity with the provisions
of the Statutes within a year from the date the Statutes took effect.
Article 36
On the day the Statutes take effect, they shall supersede the Statutes
adopted on December 21, 1990 and the Self-Management Agreement on
affiliation in the NOC.
Article 37
These Statutes shall take effect on the 8th day from the day they are
announced after the adoption.
